Safest Way general Terms of Service for iOS and Android Apps:

1. Introduction Welcome to Safest Way! Our mobile application is designed to enhance your safety by suggesting the most secure walking routes based on street lighting, CCTV, and crime data. These terms govern your use of Safest Way and any related services.

2. Acceptance of the General Terms of Service. These general terms of service (the “Terms”) set out the agreement between you and Safest Way Ltd (“Safest Way”, “we”, “us” and “our”), a company registered in England and Wales under company number 14971440 with registered office at 71-75 Shelton Street Covent Garden London WC2H 9JQ UNITED KINGDOM. Safest Way operates the website www.safestway.co.uk (the “Site”) and the Safest Way mobile application.

By Using the App, you agree to be bound by these Terms. If you do not agree to any part of there Terms, do not use the App.

3. Registration and Account Security You must register for our services by providing a valid email address and creating a password. It is your responsibility to maintain the confidentiality of your account information and to notify us immediately of any unauthorized use of your account.

4. Privacy. Your privacy is very important to us. We created our privacy policy to make important disclosures about how you can use “Safest Way and how we collect and can use your content. We encourage you to read this agreement in full, and to use it to help make informed decisions. By accepting these Terms of Service, you also confirm that you have reviewed and understand our Privacy Policy, and you acknowledge that any information shared by, or collected from or about you may be used by Safest Way in accordance to our Privacy Policy, as it is updated or changed from time to time.

If you are between 13 and 18 years old, your represent and agree that you have legal consent of your parent or guardian to access and use the App.

You understand and agree that we may change these Terms at any time without prior notice. The revised Terms will become effective upon posting in the App. Any use of App after such date shall constitute your acceptance of such revised Terms. If any change to these Terms not acceptable to you, your sole remedy is to stop accessing browsing, and otherwise using the App.

5. Use of the App You agree to:

  • Not misuse the app by engaging in illegal activities.

  • Follow all instructions provided by the app for safe navigation.

  • Acknowledge that while we strive to provide accurate data, the app's recommendations do not guarantee your safety.

6. Appstore and Google Playstore terms to apply: The ways in which you can use Safest Way and the Services may also be controlled by Apple/Google's rules and policies and those rules and policies will apply instead of these terms where there are differences between the two.

7. Support for the App and how to tell us about problems:

How we will communicate with you. If we have to contact you we will do so by email using the contact details you have provided to us.

8. Use of the App You are granted the right to download, access, and use the App and Services for your personal, non-commercial use. You agree not to:

  • Rent, lease, or transfer the App or Services.

  • Copy or modify the App, except as necessary for personal use.

9. Prohibited Transfers The rights granted to you in these Terms are personal; you may not transfer the App or Services to anyone else. If you sell a device with the App installed, you must remove the App.

10. Changes to Terms We reserve the right to modify these Terms to reflect updates or legal requirements. Notice of these changes will be provided on your next app start-up, with a 30-day adjustment period. If you disagree with the changes, you must cease using the App and Services.

11. App Updates and Service Changes We may automatically or manually update the App and modify Services to improve functionality or security. If you refuse updates, you may be unable to continue using the App.

12. Device Ownership If you use a device that you do not own, you must obtain the owner’s permission to install and use the App. You are responsible for adhering to these Terms regardless of ownership.

13. Technical Data Collection By using the App, you consent to the collection of technical information about your device and its operation to facilitate service improvements.

14. Location Data Safest Way prioritizes your privacy by not storing your location data or your recent search results on our servers. All such information is stored locally on your device only. This practice ensures that your personal navigation history remains private and under your control.

You can disable location services in your device's settings, but this will impact the App’s functionality.

12. Intellectual Property All content within the App is owned by Safest Way and protected under copyright laws.

13. Disclaimers and Liability Limitations

  • Disclaimer: We make reasonable efforts to ensure the accuracy of the data used in our app; however, we cannot guarantee that all data is error-free. Users are encouraged to exercise their discretion and consider the potential limitations of the data provided. Safest Way does not assume liability for any inaccuracies or discrepancies in the data provided by external sources.

  • No Liability for Business Losses: The App is intended for personal, non-commercial use. We are not liable for any loss of profit, business interruption, or loss of business opportunity resulting from commercial use. Contact us for terms related to commercial or business use.

  • General Information Only: The App and Services provide general information and do not guarantee personal safety. We do not promise or warrant that the App will prevent physical attacks or end them sooner.

  • Accuracy of Information: While we strive to keep the information provided through the App accurate, we do not guarantee its completeness or timeliness. Users should verify the information independently.

  • Data Backup Recommended: Users are advised to back up any content and data used in conjunction with the App to safeguard against potential losses.

  • App Suitability: The App and Services may not meet your specific requirements. Please ensure the features of the App fulfil your needs as described in the app store.

  • External Events: We are not responsible for delays or failures in providing the Services due to external events beyond our control. We will make reasonable efforts to minimize the impact of such delays. If significant delays occur, you may terminate your contract and receive a refund for any undelivered services.

  • These terms represent the full agreement between you and Safest Way.

  • No failure to enforce any provision hereof shall be construed as a waiver of any provision or right.

  • These terms are assignable by us during any corporate restructuring or sale.

  • We comply with all applicable laws, and nothing in these terms shall prevent such compliance.
